Please be sure to read the complete Auction Rules as well as the Terms and Conditions of Sale and Guidelines for Prospective Biddersand related information presented on pages below. The rules of the auction are designed to encourage and reward bidding. You will be at a disadvantage if you do not read them. A short synopsis of the most frequently requested information appears immediately following this paragraph.

AUCTION OUTLINE

  1. Auction #23 bidding will begin on May, 1st 2008.  All participants are required to register prior to bidding.  If you have registered for a past auction you do not need to re-register. 
  2. You may place bids on-line or by phone.  Phone bids will be accepted at (805) 987-3055 Monday through Friday from 9:00 AM to 5:00 PM Pacific Standard Time. On the final day of the auction phone bids will be accepted until 7:00 PM and then will follow the 15 minute rule. On-line bidding is available 24 hours a day until 7:00 PM at which point the 15 minute rule will take effect.
  3. The Auction will end at 7:00 PM pst on 5/28/08. The 15 minute rule will take effect at 7:00 PM.  The entire auction will remain open as long as bidding continues on any single item. 
  4. You may only place a bid on an item after 7:00PM if you had placed a bid on that same item prior to 7:00 PM. No new bidders will be allowed after 7:00 PM.
  5. Bidding increments will be 10%. 
  6. A 15% buyers premium will be added to the winning bid amount.
  7. All references to population came from the PSA on-line Population Report and were accurate at the time this catalog was sent to publishing on 03/14/08.  Additional information on each item may be obtained by calling (805) 987-3055.
  8. Winning bidders will be notified by e-mail within 24hrs of the end of the auction.  Hard copies of invoices will be mailed with 48 hours of the end of the auction.  Payment for winning bids must be received no later then 14 days after the close of the auction.
  9. Payment can be made with Personal Checks, Bank Checks, Money Orders, or Wire Transfers. Credit Cards, including Paypal, will not be accepted.
  10. California residents will be required to pay an additional 7.25% in sales tax.
  11. All Sales Are Final.  No returns, no exceptions. Please contact us for further information before bidding if you have any question.

Bidder Registration

If you are not currently a registered Andy Madec Auctions bidder, you can find out more about the registration process or actually register to bid on-line by clicking here or on the "REGISTER" button found at the top of the auction page in the black tgab bar. To complete your registration process, you will need to provide basic information such as your name, address, etc. plus at least 2 hobby references. It is difficult to get your registration processed on the final day so please do not wait, you may not be approved in time to place your bids. If you have consigned to or bid with us before, you are already eligible to bid in our auction. Your user name and password will remain the same. New Shipping Info:

AMSC Auctions requires a physical street address and active phone number for the delivery of our auction material.  Bidders requesting USPS delivery to a Post Office Box while assume the risk and responsibility for lost shipments.  Registered bidders should check to make sure their information is current and/or update it by logging in and clicking the "Account" button in the black tab bar at the top of the page.

 

Buyer's Premium:

Please remember there is a 15% Buyer's Premium. For example, should you win a lot for $1000.00 your actual cost will be $1150 (plus shipping, insurance and tax, if applicable).

 

A Word About Starting Bids and Lots With Reserves:

Andy Madec Auctions, Inc. believes that what makes a good auction is quality material and reasonable starting bids. The vast majority of the minimum bids in this Premier Catalog Auction are extremely low. Most opening bids represent somewhere between 15% and 25% of the fair market value. Many might be best described as nominal, while some minimum bids may be in the neighborhood of 50%-75% due to no minimum bid being set below $100.00. The purpose of the minimum bid is simply to limit inquiries to those bidders who are sincerely interested in a given item and to ensure that all lots will be sold.  At this time, Andy Madec Auctions does no place reserves on any items sold in our auctions.  However, we retain the right to employ reserves on any items in any future auction.  Should an item have a reserve placed on it, it will be noted in our description.

 

The 15 Minute Rule - How The Auction Ends:

You must place an initial bid on an item, prior to the scheduled close of the Auction at 7:00 PM Pacific Time on the auction closing day, to be eligible to bid on that item during the extended bidding period. The Extended bidding period will begin at 7:00 PM Pacific Time and last for 15 minutes.  Each time a bid is placed the 15 minute clock will be re-stated. (i.e. a bid is made at 7:05 PM the auction will no remain open until 7:30 PM.  If another bid is placed at 7:09 the 15 minutes will start again and the auctin will remian open until 7:24 PM., etc.)  This will continue until there have been no bids placed for a period of 15 minutes, at which time the auction software will automacally lock out any additional bidding attempts. All auction lots remain open while bidding continues on any one lot. This allows bidders who are bidding on a specific lot against another bidder to not lose the opportunity to bid on secondary lot should they be outbid while focused on the first lot. No bidders will be allowed to place bids on items they had not previously bid on prior to 7:00 PM Pacific Time. 

 

Payment Of Invoices:

Invoices are made available by the auction software within minutes of the close of the auction, however, shipping and handling charges will not be made available within the first 24 hours of the close of the auction.  Invoices will be mailed within 48 hours of the close of the auction.  If you would like to expoedite the receipt of your material by paying your invoice prior to receipt of the mailed copy you may print a copy of your invoice by loggin into the auction software and entering the tab titlesd "my Account". Please DO NOT send a payment if the shipping costs have not been included on the invocie. Please remember that all invoices must be paid within two weeks of the invoice date. This term of sale is very important as prompt payment of auction invoices is essential both to an orderly reconciliation of the auction and timely consignor payments. Please call to prearrange any other type of payment. Any bidder who has not paid in full without having made prior arrangements for late payment will have future bidding privileges revoked. We accept personal checks. Checks are held until funds are collected which takes 7-10 business days; it may take up to an additional 7-10 business days after funds have been collected before shipment will occur. We also accept cashier's checks, certified checks, money orders or wire transfers. These forms of payment are registered immediately and shipment of items occurs up to 7-10 days after posting. We thank you in advance for your cooperation. No Credit Cards Accepted For Payment, This Includes PayPal.

 

Terms and Conditions of Sale

  1. Items are sold to the highest bidder.
  2. You must place an initial bid on an item before 7:00 PM Pacific Time on auction closing day to be eligible to bid on that item during the extended bidding period. All lots will remain open until there have no bids placed on any auction item for a period of 15 minutes. This rule provides all bidders the opportunity to bid on the lots they are eligible to bid on without being handy-capped by time constraints.
  3. All bidders must register to obtain an account to be eligible to bid in the current auction. Once you obtain a User-name and Password, these will be your User-name and Password for all future Andy Madec Auctions, unless you change them. If you have bid with us before and cannot remember your bidder number, user-name or password or are not sure if you have an account with us, please email info@andymadec.com to find out.
  4. All new registrants will need 2 hobby references. These references will be checked. We reserve the right in our sole discretion to refuse to register a bidder or to refuse to accept bids from anyone.
  5. To top a bid, you must bid at least 10% higher by whole dollar amounts. There are absolutely no exceptions to the raise amounts. Placing a bid constitutes acceptance of the terms of sale as outlined herein. Current (real-time) bid status is available on our website with all lot listings and on the price grid.
  6. Subject to exceptions relating to credit considerations, all qualified bidders in good standing are eligible to bid on any lot in the auction, excluding employees and executives of Andy Madec Sportscards, Inc.
  7. Offers to "top all other bids" are not accepted, but you may place a "Max" bid (also known as "Up To," "Ceiling," or "Limit" bid) and the system will automatically bid on your behalf up to that amount only if and when necessary. In the event of a tie bid, the earlier received bid will be recognized as the successful bid. (See Max Bids section of the Guide for Prospective Bidders which follows these rules).
  8. All material is guaranteed genuine; we offer no reproductions unless explicitly stated. For more information about authenticity, see A Word About Authenticity at the bottom of this page.
  9. California State sales tax is charged on any purchases collected, delivered in, or shipped to the state of California, unless the purchaser has provided Andy Madec Sportscards, Inc. with a valid sales tax exemption certificate issued by the State of California.
  10. A 15% buyers premium will be added to all winning bids. For example, should you win a lot for $1000.00, your actual cost will be $1150.00 (plus shipping, insurance and tax, if applicable).
  11. Grading and condition of lots: There is a subjectivity to grading, especially the grading of cards. Every effort is made to verify the condition of each lot as it is described. We do not accept for auction any lots without careful scrutiny by not only ourselves, but, when necessary, by other leading authenticators. We cannot guarantee that every card described by us will in all cases receive exactly the same grade or even be accepted for grading by any third party grading service. No warranty, whether expressed or implied, is made with respect to any grade, condition, or other adjectival descriptions, which can and do vary, even among experts. Furthermore, we are not bound by the opinions of any authenticators, grading services, or "experts", nor do the rules governing auctions held in any of the "trade papers" or magazines in which we may advertise hold precedence over the above listed rules. All measurements are approximate.
  12. No retractions of bids are permitted. Once a bid has been placed, it may not be retracted.
  13. All Sales Are Final. No Returns Are Accepted.
  14. In no event will Andy Madec Auctions' liability to a purchaser exceed the purchase price actually paid for any lot. Andy Madec Sportscards, Inc. reserves the right to accept or reject any or all bids by any bidder and execute any bid on our own behalf. Andy Madec Sportscards, Inc. reserves the right to postpone or delay the auction, for a reasonable period of time, due to any significant, relevant event which, in the sole judgment of the auctioneer, makes it inadvisable to hold the auction as scheduled, without recourse from any bidder or prospective bidder.
  15. Title to any lot remains with the consignor or Andy Madec Sportscards, Inc. and shall not pass to the successful bidder until the lot is actually paid for in full.
  16. Payment is due within 14 days of the date of the invoice. Invoices will be mailed within 48 hours of the closing of the auction. E-mail notification will be sent within 48 hours of the close of auction. Any bidder who has not paid in full within 14 days, without having made prior arrangements for late payment will have future bidding privileges revoked. We accept personal checks. Personal checks are held for 10 business days (no exceptions) before they are deemed cleared; it can take an additional 7-10 business days after funds have been collected before shipment occurs. We also accept cashier's checks, certified checks, money orders or wire transfers. These forms of payment are registered immediately and shipment of items occurs as soon as five business and up to 10 days after posting. NO CREDIT CARDS ACCEPTED, THIS INCLUDES PayPal.
  17. Placing a bid constitutes express acceptance of all terms and provisions contained in these Conditions of Sale. In the event of a dispute, the bidder agrees to pay all of the auctioneer's reasonable attorney's fees and cost involved in collection of funds, plus 1.5% interest per month on any unpaid balance, accruing from the original due date, until the date all balances are paid. The jurisdiction for all litigation shall be in the State of California, County of Ventura or the Federal District Court of California at the discretion of the auctioneer. Bidder hereby consents to the jurisdiction of California. Each term and provision of these Conditions of Sale shall be construed as separate and distinct. In the event that any such term or provision shall be held whole by a court of competent jurisdiction to be invalid, in whole or in part, the remaining terms and provisions shall survive and be binding on both parties.
  18. If a winning bidder does not honor his or her bid with payment in full per the auction rules, then it is agreed that Andy Madec Sportscards, Inc. may, at its sole discretion, sell the given item(s) to an under bidder, or re-offer the given lot(s) in a future auction, and that the original winning bidder is responsible for any losses incurred or service charges involved in the sale of said item(s), and that the non-paying winning bidder explicitly agrees to pay any and all reasonable legal fees incurred by Andy Madec Sportscards, Inc. in the collection of these losses and/or service charges from the non-paying winning bidder if necessary.

ATTENTION:

Placing a bid constitutes acceptance of the above terms.  Andy Madec Sportscards reserves the right to reject or cancel any and all bids from any bidder for any reason.  Failure to pay for items won will result in your information being provided to all other auction houses with a warning notice.
